Please read these Terms of Service carefully before purchasing from or using the KMC Designs website and

online store. By placing an order or browsing our store, you agree to be bound by these terms. These terms are

governed by the laws of New South Wales, Australia.

1. About Us

KMC Designs is a business based in New South Wales, Australia, specialising in the design and manufacture of

custom 3D-printed consumer goods including fidget items, phone holders, desk accessories, and decorative

2. Eligibility

You must be at least 18 years of age, or have the consent of a parent or guardian, to place an order. By using

this website you represent that you meet this requirement.

3. Orders & Contract Formation

An order placed through our website constitutes an offer to purchase. A binding contract is formed only when we

send you an order confirmation email. We reserve the right to cancel or refuse any order at our discretion,

including where:

• A product is listed at an incorrect price due to a typographical error.

• We are unable to verify payment or delivery details.

• The item is no longer available.

• We reasonably suspect fraudulent activity.

Where an order is cancelled after payment, a full refund will be issued within 5 business days.

4. Pricing & Payment

All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise

stated. Prices may change at any time without notice, but the price confirmed at checkout applies to your order.

We accept payment via the methods displayed at checkout.

5. Custom & Made-to-Order Items

Many of our products are made to order via 3D printing. Production times are estimates only and may vary due

to print queue, material availability, or technical factors. We will notify you of any significant delay. Because

custom items are manufactured specifically for you:

• Custom or personalised items cannot be returned or refunded unless they are faulty or not as described.

• You are responsible for ensuring that any custom specifications (dimensions, colours, text) you provide are

accurate.

• We are not liable for errors arising from incorrect specifications submitted by the customer.6. Shipping & Delivery

We ship within Australia. Estimated delivery times are provided at checkout and are not guaranteed. Risk of loss

or damage passes to you once the order is dispatched. We are not responsible for delays caused by Australia

Post or third-party carriers. If your order is lost in transit, please contact us and we will liaise with the carrier on

your behalf.

7. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule

2 of the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major

failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have

the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a

major failure. Nothing in these Terms limits or excludes those statutory rights.

8. Intellectual Property

All designs, CAD files, photographs, logos, and website content are the intellectual property of KMC Designs

unless otherwise stated. You may not reproduce, distribute, or commercialise our designs without prior written

consent. Purchasing a product does not grant you any licence to reproduce the underlying design files.

9. Limitation of Liability

To the maximum extent permitted by law, KMC Designs' total liability to you for any claim arising out of or in

connection with a purchase is limited to the amount you paid for the relevant product. We are not liable for

indirect, consequential, or incidental loss or damage. This limitation does not apply where liability cannot be

limited under the ACL or any other applicable law.

10. Dispute Resolution

If you have a complaint, please contact us first at support@kmcdesigns.com.au so we can attempt to resolve

the issue informally. If we cannot resolve the dispute within 30 days, either party may refer the matter to NSW

Fair Trading or an appropriate tribunal. These Terms are governed by the laws of New South Wales.

11. Changes to These Terms

We may update these Terms at any time. The current version will always be available on our website. Continued

use of our store after an update constitutes acceptance of the revised Terms.
